Terms & Conditions

GENERAL INFORMATION

Before booking a Dance Service, Clients should read these Terms and Conditions carefully. These are the Terms and Conditions on which we agree to provide Clients with all Dance Services. These terms and Conditions tell Clients how we will provide our Dance Services to them, how Clients or we may change the contract between us, what to do if there is a problem and other important information. If Clients are unable to agree with the Terms and Conditions, they must not Book or attend the Dance Services. We will not provide Dance Services to Clients who do not agree to these Terms and Conditions.  If, however, the Client agrees to the Terms and Conditions unconditionally, they may Book and attend the Dance Services subject always to these Terms and Conditions. Booking Dance Services or attending Dance Services shall indicate the Client’s acceptance of the Terms and Conditions in full absolutely.

Live 4 Dancing may amend these Terms and Conditions at any time by posting the amended Terms and Conditions on the Site. The version of the Terms and Conditions that applies to the Dance Services shall always be the version in force at the time the Dance Services were booked.

BOOKINGS FOR GROUP CLASSES (KIDS & YOUTH ACADEMY)

Upon enrolment the Client is required to complete a Direct Debit mandate form. The Client’s bank account will be debited the termly fee three times a year on the nearest working day 3 weeks before the start of each term.

Any student(s) who join during the term will have their fees calculated on a pro rata basis depending on the date of enrolment during the term and in addition they will also be charged a one-off registration fee of £17.00.

It is the Client’s responsibility to check that their bank account details provided to Live 4 Dancing are up to date and to inform Live 4 Dancing of any changes (immediately as they become known to the Client which could impact on any payments to be made to Live 4 Dancing) to avoid the late payment processing fee levied by Live 4 Dancing which shall be in the sum of £25.00. Rejected Direct Debit payments incur a £25.00 late payment processing fee also. Any and all late processing fees will be added to the Client’s invoice. Failure to pay the late processing fee will result in Live 4 Dancing cancelling Dance Services provided by Live 4 Dancing.

No refunds are given for Dance Services missed during the particular term, unless in extenuating circumstances and at the sole discretion of Live 4 Dancing. No refunds shall be given to Clients by Live 4 Dancing in the event that Dance Services are cancelled due to Force Majeure Events.

Examination fees, additional show rehearsals and tickets to any of Live 4 Dancing’s events and performances incur an additional fee and these will be delivered to the Client on an ad hoc basis in advance.

TRIAL DANCE CLASSES (KIDS & YOUTH ACADEMY)

The Client is required to book and make full payment through the website or over the phone, in advance of attending a Trial Dance Class. Spaces for Trial Dance Classes are allocated on a first come first served basis and Live 4 Dancing cannot guarantee last minute availability. Once booked, a Trial Dance Class is non-refundable and non-transferable. Should the Client commit to the full term after a Trial Dance Class, the Trial Dance Class fee will be deducted from the Client’s invoice.

Trial Dance Classes can be rescheduled once, and within 2 weeks (15 days) of the date initially booked, subject to space availability. For example, a Trial Dance Class scheduled for 10th April cannot be re-scheduled for a date after 25th April. Live 4 Dancing is under no obligation to provide an alternative session should the Client be unable to attend the Trial Dance Class booked.

PRIVATE LESSONS AND PACKAGES

Private Lessons for Clients are required to be agreed, arranged and booked by Clients in advance via online payment or a bank transfer. Live 4 Dancing does not accept cash payments and cheques from Clients for payment on the day of the Private Lesson. To secure the Client’s booking(s), payments need to be made in full at least 7 (seven) working days prior to the Client’s requested date(s). Payments made less than 7 (seven) working days prior to the Client’s requested date(s) the Private Lesson will be transferred to the following week at the sole discretion of Live 4 Dancing.

Due to the individual nature of the booking Live 4 Dancing requires a minimum of 7 (seven) working days notice in order to transfer a private lesson with the studio and the designated Live 4 Dancing instructor. Provided that the sufficient notice is given, Live 4 Dancing will change a Client’s booking subject to availability of the Live 4 Dancing instructor and studio space and will charge for all and any ancillary and administrative costs associated with  the initial booking, (including but not limited to booking a studio space for example) . If changes are required to be made with less than the required notice prior to the date set for the Private Lesson, then the Client will be charged the full fee of the Private Lesson plus the studio hire fee where applicable and any other associated and ancillary and administrative costs These costs shall be invoiced to the Client.

Paid fees for either one-off Private Lessons or block bookings are non-refundable in whole or in part and it is the Client’s responsibility to book all sessions at the times provided as available for the designated instructor and the studio space.

For the avoidance of doubt if a Client arrives late for a  private lesson which therefore results in a reduction of the time available for the Client’s Private Lesson  then no reduction in the fee levied by Live 4 Dancing for that private lesson will be given due to less time being made available for the Client because of their late arrival.

DANCE WORKSHOPS

Bookings by Clients for Dance Workshops must be made with a minimum of fifteen (15) working days’ prior notice to allow for the securing of a venue and a tutor for Live 4 Dancing’s or the Client’s selected date. Bookings for Clients are confirmed only upon receipt of full payment from the Client due not later than fifteen (15) working days before the date of the Dance Workshop.

ONLINE DANCE CLASSES

Online dance classes take place via the Zoom app. An email address and phone number must be provided by the Client for the teacher to contact them on. All online dance classes  MUST take place on a secure wifi connection to ensure the Client and teacher are protected from hacking and they have privacy.

Clients taking part, learning or dancing along with this dance video, dance clip or dance stream do so at their own risk. Live 4 Dancing does not accept any responsibility for each individual or group of individuals who may be watching, joining in or dancing along with this dance video, dance clip or dance stream. In order to take part/learn/dance along with this dance video, dance clip or dance stream Clients must first make sure that they are in good enough health/physical condition to be able to do so. If Clients are under doctor’s orders, have an underlying health condition or have received medical advice that would normally preclude them from a physical activity (such as dance and/or dance fitness) they should not join in or dance along with this dance video, dance clip or dance stream.

Clients must create a safe area to dance in. Clients must make sure that the area they are about to dance/exercise in is suitable for the type of dance or exercise that is contained in the dance clip, dance video and dance stream they are about to watch. The area must be a flat surface, be clear of obstruction (such as tables, light fittings, rugs), be big enough and again suitable for the style of dance/dance exercise Clients are about to take part in. Pets and young siblings should be kept in a separate room.

Comfortable and suitable clothing and shoes should be work during the dance class. Clients should be keep hydrated during the dance class.

Where possible, a parent or guardian must be present in the premises of the students’ location if they are under 16.

All purchases for online dance classes are final. In extreme circumstances will a refund be issued due to a breach of contract from the teacher.

DRESS CODE

Clients must abide to the dress code of Live 4 Dancing as outlined on the website and are expected to attend the Classes or Courses or Private Lessons or Dance Workshops in appropriate Ballroom & Latin dance shoes at all times. Failure to adhere to the Dress code may mean that a Client is suspended from the particular Class or Course or Private Lesson or Dance Workshop as the case may be.

SAFETY

Clients must vacate a studio on time. Clients aged 14 and under must be collected on time without fail and have a nominated adult on site 10 minutes before the end of their Class or Course, Private Lesson or Dance Workshop as the case may be.

Please be aware that Live 4 Dancing is under no obligation to enquire about leaving or collection arrangements and accepts no responsibility for such. Live 4 Dancing is NOT responsible for Clients and/or their children before and after Classes, Courses Private Lessons and Dance Workshops as the case may be.

Clients who have children aged 7 years and under must have a parent or nominated adult on site at all times in case they require the toilet. Live 4 Dancing’s dance instructors cannot accompany children aged 7 years and under to the toilet. Clients who have children aged 7 years and under who attend Kids Classes, Courses, Private Lessons or Dance Workshops should bring a bottle of water for their children and take them to the toilet before the start of their Class, Course, Private Lesson or Dance Workshop as the case may be.

MISSED CLASSES AND COURSES

If a Client is unable to attend a Class or Course or Private Lesson or Dance Workshop for any reason Live 4 Dancing does not guarantee any alternative arrangement and for the avoidance of doubt in such circumstances the Client will receive no refund in respect of that booking.. If however Live 4 Dancing at its sole discretion is able to offer an alternative session for the Class, Course, Private Lesson or Dance Workshop as the case may be and the Client chooses not to accept the alternative that is offered the Client shall NOT entitled to a refund in such circumstances either. If the Client is or becomes aware that they will miss any sessions in advance of the start of a Course, Class, Private Lesson or Dance Workshop, then  the Client must immediately notify Live 4 Dancing at the time of Booking and Live 4 Dancing will endeavour at its sole discretion to provide an alternative session of said Class, Course, Private Lesson or Dance Workshop as the case may be however for the avoidance of doubt Live 4 Dancing does not guarantee that such an alternative session will be made available.

Please be aware that Live 4 Dancing is under no obligation to offer alternative or replacement sessions of any Classes, Courses, Private Lessons or Dance Workshops. If a Client misses a session for 3 weeks in a row then the Client’s place will be opened up as a space, and filled immediately by Live 4 Dancing without notice.

CANCELLATIONS AND TRANSFERS 

Kids Academy: Cancellations by Clients up to 48 hours (2 working days) before the payment due date are eligible for a 100% refund. Cancellations less than 48 hours (2 working days) before the payment due date will receive no refund. All cancellation requests must be sent by Clients to Live 4 Dancing by email and it is the Client’s responsibility to ensure that the email cancellation is not only sent but received also. Funds for children’s Dance Classes are non-transferable to any other Dance Services.

All other Dance Services: Once Booked and paid for, all other Dance Services are non-refundable and non-transferable save as otherwise. Live 4 Dancing requires a minimum number of Client Bookings for holding each individual Course, Class, Private Lesson and/or Dance Workshop and consequently the holding of such sessions is conditional upon this requirement being satisfied. If that minimum number is not achieved by the day after the deadline for booking has expired, Live 4 Dancing reserves the right to cancel the Course, Class, Private Lessons and/or Dance Workshop or Term of Classes and in this instance will provide a full refund or offer an alternative Course to attend.

No refunds are given for Dance Services missed unless in extenuating circumstances and at the sole discretion of Live 4 Dancing. No refunds shall be given to Clients by Live 4 Dancing in the event that Dance Services are cancelled due to Force Majeure Events.

VARIATIONS TO SCHEDULED COURSES AND TERM OF CLASSES

On some rare occasions it may be necessary for Live 4 Dancing  to make alterations to the start date, time, teacher or venue locations of the Classes or Courses or Private Lessons or Dance Workshops in order to operate these sessions effectively. All Clients will be notified on email of any such changes as soon as it is reasonably possible. The Client accepts that any such change(s) shall not constitute a breach of contract on the part of Live 4 Dancing and therefore the Client shall have no right to terminate the agreement or seek damages or seek a refund.

If Live 4 Dancing is required to change the venue for a particular class due to Fore Majeure Events then Clients shall act reasonably in accepting  an alternative venue. Live 4 Dancing is not obliged to offer any alternative venue.

Live 4 Dancing will use reasonable endeavours to ensure that the venue shall be the venue indicated on the Site, but where this is not possible, Live 4 Dancing reserves the right to procure the use of other venue(s), provided that Live 4 Dancing shall give the Client notice on email of any such change(s) as soon as it is reasonably possible. Any such change(s) shall not constitute a breach of contract and shall not give the Client the right to terminate the agreement or seek a refund.

Live 4 Dancing will use reasonable endeavours to ensure that any individually named teacher(s) shall provide the relevant Classes or Courses or Private Lessons or Dance Workshops but where this is not possible, Live 4 Dancing reserves the right to procure the services of suitable alternative teacher(s), provided that Live 4 Dancing shall give the Clients notice of any such change(s) on email as soon as is reasonably possible. Any such change(s) shall not constitute a breach of contract and shall not give the Client the right to terminate the agreement or seek a refund.

CODE OF CONDUCT

In order to maintain the high standards of our Dance Services Live 4 Dancing reserves the right at its sole discretion to refuse admission or participation to any Client who is deemed to be acting inappropriately. This includes, but is not limited to, behaviour that displays an actual or perceived conflict of interest or behaviour that hinders the learning of others.

Live 4 Dancing expects all Clients to be polite and well mannered towards other Clients and their Live 4 Dancing dance instructors at all times. If a Client is excluded for unacceptable behaviour they will not be entitled to a refund and in extreme circumstances Live 4 Dancing reserves the right to cancel the contract with the Client completely and immediately without notice in which case no refund will be due to the Client.

INJURY WAIVER AND EXCLUSION OF LIABILITY

By agreeing to these terms and conditions the Client hereby waives, releases and discourages all claims they may have against Live 4 Dancing for injuries of any manner from participation in the Dance Services unless they are a direct result of Live 4 Dancing negligence. The Client is obliged to seek medical advice before carrying out any exercise. The Client agrees not to attend a Class, Course, Private Lesson or Dance Workshop where they suffer from or consider that they may suffer from illness or injury or both as the case may be.

If the Client is late for a Class, Course, Private Lesson or Dance Workshop then Live 4 Dancing reserves the right at its sole discretion to refuse admittance, as the Client could risk injury if he/she has missed part of the warm up. The Client will not be entitled to a refund in such cases.

It is the Client’s responsibility to report any changes to personal details i.e. health, medication, address and contact details, to Live 4 Dancing prior to the Client undertaking any Class, Course, Private Lesson or Dance Workshop.

Live 4 Dancing accepts no liability for any loss or damage to personal property or for any loss sustained by a Client from errors or omissions contained on the registration form whether completed by the Client or otherwise.

RECORDING & PHOTOGRAPHY

All and any recording and photography by Clients (or those associated with Clients in any way) during any of Live 4 Dancing’s Classes. Course, Private Lessons or Dance Workshops are strictly prohibited. Clients hereby consent to Live 4 Dancing photographing Clients and taking video recordings for the purposes of promoting Live 4 Dancing’s Dance Services only.

DATA PROTECTION AND PRIVACY

Live 4 Dancing is committed to protecting the privacy and confidentiality of its Site users and Clients. Live 4 Dancing’s privacy notice applies to the use and processing of personal data collected and used by Live 4 Dancing, in accordance with the requirements of the General Data Protection Regulation 2018 (GDPR). It is very important that the information Live 4 Dancing holds about its Clients is accurate and up to date. It is the Client’s responsibility to inform Live 4 Dancing know of any changes in personal information by emailing info@live4dancing.co.uk.

GOVERNING LAW

These Terms and Conditions and every agreement for the provision of Dance Services shall be governed in all respects by English law as if the contract was wholly entered into and wholly performed within England. The parties hereby submit to the exclusive jurisdiction of the English court.

Defined Terms:

Client: An individual who purchases Dance Services for themselves or on behalf of another  and where, for the avoidance of doubt a person purchases Dance Services for a child or on behalf of another person then Client shall mean the purchaser of the Dance Services or the person or Child for whom the Dance Services were acquired as the case may be under these Terms and Conditions as relevant.

Live 4 Dancing: The trading name for Live 4 Dancing Dance Academy.

Dance Services: Services organised or supplied by Live 4 Dancing. This includes (but is not limited to) dance classes, dance courses, drop-in classes, trial sessions, private lessons and dance workshops.

Terms and Conditions: The Conditions that govern the sale and supply of Dance Services by Live 4 Dancing to you.

Booking (includes any capitalised division): A Client’s order or acceptance of an offer for Dance Services.

Site: The website www.live4dancing.co.uk

Course: A dance programme provided by Live 4 Dancing consisting of more than one dance class/session.

Term of Classes: A dance programme consisting of more than one dance class/ session, over the period of 3 to 4 months.

Trial Dance Class: A single, one-off dance class/session provided by Live 4 Dancing that could also form part of a Course/Term of Classes.

Drop-in Sessions: A single, dance class/session provided by Live 4 Dancing.

Private Lessons: A bespoke dance class/session provided by Live 4 Dancing that is requested, scheduled and shaped according to an individual Client’s request.

Packages: A series of dance classes/ sessions provided by Live 4 Dancing that are requested, scheduled and shaped according to an individual Client’s request.

Dance Workshops: A dance class/session that is requested, scheduled and customised for groups by Live 4 Dancing or a Client.

Online dance classes: A dance video, dance clip or dance stream that is delivered via online media.

Force Majeure Events: means any circumstance not within the reasonable control of Live 4 Dancing including without limitation acts of God, flood, drought, earthquake or other natural disaster, epidemic, pandemic, terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo or breaking off of diplomatic relations, nuclear, chemical or biological contamination or sonic boom, any law or action taken by a government or public authority including without limitation imposing an export or import restriction, quota or prohibition, collapse of buildings, fire, explosion or accident and any non performance by contractors or the interruption to any and all utility services; and in such circumstances if Live 4 Dancing is hindered, prevented or delayed in providing or meeting its obligations under these Terms and Conditions by the above Force Majeure Events then Live 4 Dancing shall not be in breach of these Terms and Conditions or otherwise liable for any delay or failure in the performance of its obligations under these Terms and Conditions.

Working Days: means a day other than a Saturday, Sunday or public holiday in England when banks in London are open for business.
